Definitions
The following definitions apply in the context of these Terms and Conditions:

"Terms": these Terms and Conditions

"Web Sites": santabarbarastudenthome.com (including all of its pages);

"We" ("Us", "Our" etc): Santa Barbara Student Home, its management, its employees, its subcontractors, its agents and affiliates;

"Services": all services provided by Us through the Web Sites, communications, reservations, bookings, payment services, accommodations and all services related to accommodations;

"Premises": the entire Student Home including bedrooms, shared rooms, yard, and other facilities, and including all furniture, fixtures, appliances and plants;

Terms and Conditions
These Terms apply to your use of the Web Sites, our brochures, information and other materials, as well as all our Services. The Terms and the items made a part of these Terms by reference (which include our house rules), make up the agreement between us and you relating to:

your use of the Web Sites, and

your use of our Services.

If a court finds any of the Terms to be unenforceable or invalid, the unenforceable or invalid Term will be enforced to the fullest extent permitted by applicable law and the other Terms will remain valid and enforceable.

Minimum Age
You may only use the Web Sites and use our Services if you are at least 18 years of age and can enter into binding contracts.

Acceptance of Terms and Conditions
Please read these Terms carefully before using or obtaining any information through santabarbarastudenthome.com, or before using any Services of Santa Barbara Student Home By accessing santabarbarastudenthome.com and/or by using any of our Services (which explicitly includes all bookings and accommodations at the Premises), you agree to accept all of these Terms without limitation or qualification. If you do not accept these Terms, please exit santabarbarastudenthome.com immediately, do not use any Services, do not contact us, do not make any reservations and bookings, and do not use accommodations at our Premises.

Information
The Web Sites, our brochures and other materials available through the Web Sites, as well as our email communications offer information on properties managed by Us, the various Services offered by Us, and other general information; the information may have been provided from various individuals and organizations. We make our best efforts to ensure that this information is accurate, however, we cannot guarantee its accuracy. The Web Sites are provided on an "as is" basis without warranties of any kind, either express or implied. We do not endorse or are responsible for the accuracy or reliability of any content on our Web Sites. Your use of the Web Sites is at your own risk. Our Web Sites may also contain links to other sites; we expressively disclaim all responsibility for any referrals made. You, as the ultimate recipient of any referred products or services, assume full responsibility for interviewing, investigating and qualifying any product, service, company, or individual referred to you by Santa Barbara Student Home and its Web Sites. You agree and hold Us harmless from and against any and all claims, actions, and damages (including attorneys' fees) resulting from your use of any product, service, company, or individual referred to you by Us and the Web Sites. Access to and use of the Web Sites is subject to any specific terms and conditions set forth on the individual pages within the Web Sites and these Terms, and all applicable laws and regulations, including laws and regulations governing copyright and trademark. We reserve the right at any time to change any of the Terms or any information contained in the Web Sites; this includes information on Services provided, fees and prices. Any such changes will appear on the individual pages of the Web Sites and/or on this screen. By using the Web Sites, you agree in advance to accept any such changes.

Copyrights and Trademarks
The content included on the Web Sites, including but not limited to text, software, photographs, graphics, illustrations and artwork, video, music and sound, and names, logos, trademarks and service marks, are the property of Santa Barbara Student Home or its licensors or suppliers and are protected by copyright, trademark and other laws. You agree not to modify, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material for any purpose other than personal, non-commercial use (or legitimate activities of a language school or other school, an agent of a language school or other school, a travel agent or travel professional) without our written permission. To request such permission, send email to infoa-tsantabarbarastudenthome.com, including your name, address and a description of the purpose of your intended distribution and the information you would like to distribute.

Indemnification and Liability

We shall not be liable for any direct, indirect or consequential damages arising from the use of Our Web Sites, the use of Our brochures, email communications, or any other materials or information provided by Us.

We shall not be liable for any direct, indirect or consequential damages arising from any inability to access, use or understand the Web Sites and their content.

Additional exclusions are listed below under "Accommodations".

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability in such jurisdictions shall be limited to the extent permitted by law. You hereby waive any and all claims against us arising out of your use of the Web Sites, the use of our brochures, email communications, or any other materials or information provided by us.

Hold Harmless
By accessing the Web Sites and/or by using Services you agree to hold harmless Santa Barbara Student Home from and against any and all claims, actions, and damages (including attorneys' fees) resulting from your use of the Services, Web Sites and the content of the Web Sites, and any other information provided by Us.

Governing Law and Choice of Forum
These Terms and any disputes arising out of or related to our Services (or the use of our Services), the Web Sites (or use of the Web Sites), and information provided by us, shall be governed by, construed and enforced in accordance with, the laws of the State of California. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms, your use of the Web Sites, your use of information and communications provided by us, or your use of our Services shall be filed only in the state or federal courts located in the State of California, County of Santa Barbara, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

Privacy Policy
Santa Barbara Student Home is concerned about your privacy and strictly follows the following policy:

We keep your personal information private. We use your information only to provide you with the best services we can.

We do not sell your personal information to third parties.

We oppose spam. You can always request to have your name removed from our mailing lists.

Reservations and Accommodations

The following Terms apply specifically to accommodations at our Premises, as well as to reservations, bookings, payments and pricing.

Acceptance of these Terms
Please read these Terms carefully before making a reservation, booking, or payment, or before using accommodations at our Premises or any other Services of Santa Barbara Student Home By booking accommodations with Us, either directly or indirectly through a booking agent or other third party, you agree to accept all of these Terms without limitation or qualification. If you do not accept these Terms, you cannot use our accommodations.

Shared Housing
We offer accommodations to our residents in the form of shared housing. All residents share their rooms with other residents (except single occupancy); they also share the rest of the Premises with other residents.

Residents agree to live together with their roommates and to equally share the Premises: the bedrooms are only shared among the residents assigned to them, while all other areas are shared among all Residents.

Residents live together and use the Premises as a single housekeeping unit (similar to a big family) sharing rights and responsibilities.

Residents are collectively and individually fully responsible for the Premises, including for any damages or theft, cleanliness and hygiene, and safety.

Residents are not allowed to change their assigned room without our explicit permission.

Included Services
Our shared housing includes for our residents without additional charges the following services in amounts that are considered usual and appropriate for residential accommodations:

the use of the following utilities: electricity, hot and cold water, local phone services, cable TV, WiFi internet;

management services;

periodic cleaning services of common areas;

Commercial use and any use of our services that exceeds normal personal usage of the residents are strictly prohibited.

Rules and Regulations
Residents agree to follow the house rules and all other rules (written and oral), laws and regulations whether adopted before or after the date of reservation or the date of move-in. A violation of the house rules or any other rules, laws and regulations will constitute a violation of our agreement with the resident, and we may at our sole discretion issue a verbal or written warning, and/or require the resident to pay a penalty, and/or require the resident to move out immediately (in which case any pre-paid rent will NOT be refunded to the resident).

Condition of Premises
Unless otherwise indicated at the time of resident's move-in, the residents acknowledge that the Premises, including furniture, fixtures and appliances, are in good order and repair, and in safe and clean condition.

Moving out of the Premises
At the expiration or termination of their accommodation at the Premises, the residents shall leave the Premises (including its furniture, fixtures, and appliances) in the same good condition as when moved in, normal wear and tear excepted.

Residents agree to move out during the established check-out time on the day of their scheduled departure.

Residents agree to return all items received from Us (for example, keys, dish sets, linen...) at the time of departure otherwise the resident will be charged for them (even if returned at a later date).

Residents agree to remove all personal belongings (including trash) from their rooms and common areas (including fridges) by the time of checkout, and leave the Premises in the same condition as on arrival. Any delays past the established check-out times may be charged as extra day.

Damages and Repairs

Residents agree to notify Us immediately if there is any damage, defect or destruction of the Premises (including furniture, fixtures and appliances). Unless the damage, defect or destruction is the responsibility of the resident, We shall use our best efforts to repair or replace such damaged or defective area, furniture, fixture or appliance.

Residents are responsible for all damages (excluding normal wear and tear) to the Premises (including its furniture, fixtures, and appliances) caused by them, their family, agents or visitors.

Residents' responsibility for damages may exceed the security deposit. In this case, residents must reimburse Us within 1 week.

If the Premises are partially damaged by fire or other casualty not due to residents negligence or willful act, or that of their family, agents or visitors, there shall be an abatement of rent corresponding with the time during which, and the extent to which, the Premises are unusable. If such damage or destruction occurred as the result of the negligence of resident, their family, agents or visitors, then there will be no refunds of pre-paid rents or deposits.

No Security System
All Residents acknowledge that We don't provide a security alarm system or any security for the Premises or for the residents. Residents hereby release Us from any loss, suit, claim, charge, damage or injury resulting from lack of security or failure of security (including the failure of locks).

No Insurance
All Residents acknowledge that We will not provide insurance coverage for Residents and Residents' property.

We provide a free shuttle service exclusively for our Residents. Our Residents acknowledge that the use of the shuttle service is at the own risk of our Residents, and that we will not provide insurance coverage for Residents and Residents' property in case of accident or other adverse circumstances.

Access and Privacy
Due to the nature of shared and managed housing, we have the right to enter the entire Premises at any time and for any reason. We will, however, make an effort not to enter residents' bedrooms unless we deem necessary (for example, if we suspect that rules may be broken, or in order to ensure cleanliness, or for repairs and maintenance, for example).

Reservations
Please send Us your reservations request using the online reservation request form. If We confirm your reservation in writing, we will issue an invoice by email. Only written confirmations are valid. Please note that We may cancel your reservation if We don't receive the full reservations deposit or prepayment (depending on the rate you selected) within one week of the invoice date or by the due date shown on the invoice, whichever comes first.

Payment Options
You may pay through any of the following payment options:

bank transfers and deposits into our bank account (our invoice will show the bank information);

credit cards online (a small convenience fee applies);

Regular Price
You may make a booking at our Regular Price anytime. We will collect a non-refundable reservations deposit at the time of booking. Refunds of rent payments may be possible subject to the terms below.

Reservations Deposit: After you received a written confirmation of your reservation and your invoice, you need to make a deposit to hold your reservation (reservations deposit) by the due date (usually within one week of invoice). The reservations deposit is $50 per reserved week for double and triple rooms, and $100 per reserved week for single rooms. The reservations deposit will be applied towards your rent but it is non-refundable in any case (for example, if you cancel your reservation or if you fail to arrive on your scheduled arrival day).

Rent Payment: The remainder of your total rent is due no later than your scheduled arrival date. As an alternative, you may choose to pay the remaining rent in intervals of at least 4-weeks starting on your check-in day.

Automatic Cancellation: If you fail to make your rent payment on or before your SCHEDULED arrival day, your reservation may automatically be canceled. Therefore, you MUST contact us if your arrival is delayed in order to reschedule your arrival and in order to get our permission for alternate and/or delayed payment.

We only hold reservations for periods that We confirmed in writing and for which We received a reservations deposit.

Cancellation and Refunds: Rent payments (excluding the reservations deposit) are refundable if cancelled at least 28 days in advance. No refunds if cancelled less than 28 days in advance. There are absolutely no refunds for reservations deposits.

Prepay Price
Our prepay price offers a big discount from our regular price. However, all rent payments are non-refundable in case of cancelation or early move-out.

The Prepay Price only applies to reservations for a stay of 12 consecutive weeks or more.

Rent Payment: After you received a written confirmation of your reservation and your invoice, you need to prepay the total rent by the due date (usually within one week of invoice). This payment is non-refundable in any case (for example, if you cancel your reservation).

Automatic Cancellation: If you fail to prepay your total rent by the due date, your reservation may automatically be canceled.

Cancellation and Refunds: All payments of the Prepay Price are non-refundable in any event.

Extensions
Extensions of stay can me made subject to the terms regarding reservations and rates above. All extensions are subject to availability, and no extension is guaranteed until payment of the reservations deposit (regular price) or full payment (prepay price) has been received. Prices, terms and conditions for extensions are those prices, terms and conditions that are in effect at the time of booking an extension.

Cancellation
Residents may cancel parts of their reservation or their entire reservation at any time. Refunds and cancellation fees depend on the kind of rate paid (please see above 'Regular Price' and 'Prepay Price').

We may cancel the remaining part of a reservation in case of an applicable violation of Our house rules (please see above "Rules and Regulations') at any time and without advance notice. We may also cancel parts of a reservation or an entire reservation in case the Premises are damaged in a fire or otherwise, in case the Premises can no longer be provided in the same form due to a change of law or ordinance or their interpretation, in case of imposition of a tax, fee or other event that would significantly increase Our expenses, in case of a change in the terms of Our lease for the Premises, or otherwise at any time and without advance notice. If the cause of cancellation is not due to residents negligence or willful act, or that of their family, agents or visitors, there shall be a pro-rated rent refund for the cancelled rent period.

Late Payment
Generally, all payments are due prior to the start of the rental period and as shown on the invoice.

If you booked a room and your payment is late: We may, at our sole discretion, cancel any reservation or booking if payment is not received by the due date.

If you are already staying at the Student Home and your payment is late: As a general rule, you can only stay at the Student Home if you paid for your accommodations and security deposit. This means that you will have to move out if you are staying at the Student Home but you haven't paid the rent and/or security deposit. We may, at our sole discretion, allow you to stay even though your payment is late; in this case we will charge a late fee of $50 for every 3 days during which payment is past-due.

Security Deposit
Security deposits are refundable upon move out. We usually refund the security deposit (minus any deductions) in cash immediately at the time of move out. Only in rare circumstances and at Our sole discretion, We will send a check within approximately 2 weeks of move-out.

Promotions
We may make information regarding specific programs, offers or promotions, which we are conducting, available on the Web Sites and/or our brochures and/or email campaigns. Any such program, offer or promotion is subject to the specific terms, conditions and restrictions listed in connection with such program, offer or promotion. We reserve the right to alter or withdraw any program, offer or promotion at any time without notice. Each program, offer and promotion is void where prohibited by law. Please refer to and read carefully the terms, conditions and restrictions in connection with each program, offer or promotion.

Indemnification and Liability

We shall not be liable for any theft, destruction, loss or damage to any property of the residents, their family, agents or visitors.

We shall not be liable to residents for any act of violence (no matter if caused by another resident or by anybody else), nor shall We be liable for damage caused by failure of heating equipment, or from plumbing or fixtures or furniture or appliances; nor for any damage arising from the acts or neglect of roommates or other residents of Premises; or from acts of God or other occurrences that We cannot control.

We shall not be liable for any damage or injury occurring on the premises to residents, or any other persons, guests, or invitees, or to any property thereof.

We shall not be liable for any damage or claim resulting from Our cancellation of a partial or entire reservation as described above under 'Cancellation".

All residents agree to hold Us harmless from any claims for damages arising out of residents' use of the Premises, and to indemnify Us for any expense occurred by Us in defending any such claims.

Booking Agents

The following Terms apply specifically to booking agents and other third parties making reservations and bookings on behalf of or for the benefit of others.

Acceptance of these Terms
Please read all of the Terms on this website carefully before making a reservation, booking, or payment, or any other Services of Santa Barbara Student Home By booking accommodations with Us for another party, you agree to accept all of these Terms without limitation or qualification.

Applicability to Residents
Accommodations at our Premises are governed by the Terms on this website (including our house rules). Booking agents and other third parties making reservations and bookings on behalf of or for the benefit of others are reminded that the Terms also apply to those who will be accommodated at our Premises.

Commissions
We welcome bookings through booking agents. Commissions are offered to partnering booking agents in order to offset their costs related to marketing and booking. Booking agents who wish to become partner agents may send an inquiry to us by email. In order to be eligible for commission payment, the booking must be made by the Partner Agent directly with us. If a Partner Agent books directly with us an extension of stay, the extension is also eligible for commission payment. We will subtract the commission directly on the invoice, or, upon request by the Partner Agent, issue commission payment by PayPal.
